Terms of Service

These Terms of Service ("Terms") govern your access to and use of all products, applications, websites, and APIs operated by MQuantum (business registration 309-96-05114, sole proprietor in the Republic of Korea), trading as SwiftQuantum ("we", "us", "SwiftQuantum"). Please read them carefully — by creating an account or using the Services you agree to be bound by these Terms.

1. Services Covered

The "Services" include, without limitation:

• iOS / macOS / visionOS apps: SwiftQuantum (Quantum Circuit IDE), QuantumNative (24-Level Education), Q-Bridge (Hardware Control), QuantumCareer (Skills & Jobs), Q-Alpha (QRNG Financial Risk), Q-Shield (Compliance Planning), Q-Logos (Logistics & Routing), Q-Bio Genesis (Research Use Only).
• Websites: swiftquantum.tech, quantumnative-edu.swiftquantum.tech, legal.swiftquantum.tech, the SwiftQuantum Admin console, and affiliated domains.
• APIs: SwiftQuantum Legal API (api.swiftquantum.tech/api/v1/legal), SwiftQuantum platform APIs, and developer SDKs we publish under our organization on GitHub, Maven Central, and PyPI.

2. Geographic Scope and Targeted Distribution

The Services are operated from the Republic of Korea. Chinese-language content is intended for the global Chinese-speaking diaspora (Chinese Americans, Singaporeans, Taiwanese, Hong Kong residents, Malaysians, and similar). The Services are not distributed in mainland China or in Russia, and SwiftQuantum applications are not published on mainland-China or Russian app stores. We do not represent compliance with mainland-China or Russian legal regimes.

3. Eligibility and Accounts

• You must be at least 13 years old to create an account. If you are under 16, parental or legal-guardian consent is required (and is required for under-13 use after the verified-parental-consent flow described in our Privacy Policy).
• You must provide accurate registration information and keep it current. You are responsible for all activity under your credentials.
• You may hold one account per email address; bulk or automated account creation is prohibited.
• You are responsible for the security of your password. Do not share it. Notify us at security@swiftquantum.tech if you suspect unauthorized access.

4. Subscriptions and Payments

4.1 Plans

Equivalent local-currency pricing applies in App Store / Google Play / web checkout per the platform's billing rules. Prices may differ in QuantumNative EDU and other apps; see the in-app paywall for the binding price at purchase time.

4.2 Billing

Subscriptions auto-renew at the end of each billing period unless cancelled. Apple App Store and Google Play subscriptions are managed through your platform account; web subscriptions through Stripe.

4.3 Free Trial

A 7-day free trial may be offered for paid plans. Cancel before the trial ends to avoid being charged. Trials are limited to one per user.

4.4 Refunds

• Web subscriptions (Stripe): 7-day money-back guarantee from the date of first purchase, requested via support@swiftquantum.tech.
• App Store / Google Play subscriptions: refunds are processed by the platform under their own refund rules. We can advocate but cannot directly issue refunds for these.
• Quantum-hardware credits: non-refundable once consumed by a hardware execution. Unused credits remain in your account and may be used until expiration disclosed at purchase.

4.5 Price Changes

We may change subscription prices with at least 30 days' advance notice by email and in-app banner. Existing subscriptions continue at the prior price for at least one full billing cycle after the notice; new pricing applies on the next renewal after the notice period.

5. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes or in violation of any law applicable to you;
• Reverse engineer, decompile, or disassemble the Services except where such restriction is prohibited by applicable law;
• Scrape, bulk-download, or automate access except through documented APIs and within published rate limits;
• Share account credentials or resell access without our written consent;
• Submit content that is illegal, infringing, abusive, defamatory, pornographic, or that targets minors inappropriately;
• Submit malware, malicious circuits, or attempt to compromise our infrastructure or other users;
• Use the Services to develop or deliver weapons systems beyond what is permitted under applicable export-control law (see Section 11).

We may suspend or terminate accounts that violate this Section, with or without notice depending on severity, and we may report criminal conduct to law enforcement.

6. Intellectual Property

6.1 Our Content

The Services, including software, documentation, branding, the QuantumNative EDU knowledge base, the SwiftQuantum Legal regulation data set, and the design and arrangement of all of the foregoing, are owned by MQuantum / SwiftQuantum or our licensors and protected by copyright, trademark, and other laws. Except as expressly granted, no license is conferred.

6.2 Your Content

You retain ownership of the quantum circuits, projects, notes, portfolios, and other content you create using the Services ("Your Content"). By using the Services you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, and display Your Content solely as necessary to provide the Services to you (for example, to sync between devices, to back it up, and to render it in the UI). This license terminates when you delete the content or your account.

We will not use Your Content to train AI models or to advertise products to you. We will not share Your Content with third parties except as described in the Privacy Policy or with your explicit consent.

6.3 Certificates

Educational certificates issued by QuantumNative are for personal use, non-transferable, and do not constitute professional or accredited credentials unless explicitly so stated.

7. Quantum Hardware Use (Q-Bridge and dependent apps)

When you submit a circuit to a third-party quantum backend through Q-Bridge or any other Service:

• The submission is subject to the applicable hardware provider's terms (IBM Quantum, IonQ, Rigetti, or others you select).
• Hardware availability is not guaranteed. Queue times, calibration windows, and outages may delay or prevent execution.
• Quantum noise and decoherence are inherent. Shot-by-shot variance is expected and does not constitute a service defect.
• Hardware-execution credits are non-refundable once consumed, including credits consumed by submissions that fail at the hardware provider's side (which is not within our control).
• We anonymize submissions before forwarding (no account email, display name, or device identifier).

8. AI Services Disclosure

The AI Tutor and related features rely on Anthropic PBC's Claude model under Standard Contractual Clauses (SCCs):

• Anthropic stores AI message content for up to 90 days for abuse-monitoring purposes.
• Default setting is opt-out of model training.
• AI output may be inaccurate. Do not rely on AI output for legal, medical, financial, or safety-critical decisions.

9. Privacy

Use of the Services is subject to our Privacy Policy, available at /privacy. The Privacy Policy is incorporated by reference into these Terms.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR THAT ANY DEFECT WILL BE CORRECTED.

The SwiftQuantum Legal API and Compliance pages provide educational and reference information only, monitored on a 12-hour scrape cycle. This is not legal advice. Consult qualified legal counsel for compliance guidance in your jurisdiction. SwiftQuantum is not a law firm.

11. Export Control and Compliance

The Services and any technology made available through them may be subject to U.S. Export Administration Regulations (EAR), Korean Industrial Technology Protection Act, EU dual-use regulations, and other applicable export-control regimes. Quantum computing items have specific ECCN classifications (notably 4A906 / 4D906 / 3A901 / 3A904 / 3E901 / 4E906 introduced 2024–2025). You agree to comply with all applicable export-control laws and not to use the Services in a manner that would cause us to violate them.

By using the Services you represent that:

• you are not located in a country embargoed by the Republic of Korea, the United States, or the European Union;
• you are not on a denied-party or sanctions list;
• you will not export, re-export, or transfer the Services to a prohibited end-user or for a prohibited end-use.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MQUANTUM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF:

(a) the amount you paid us for the Services in the twelve (12) months preceding the event giving rise to liability; or

(b) USD 100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for consequential or incidental damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless MQuantum, its representative, and its officers and contractors from any claim arising out of your violation of these Terms or your misuse of the Services.

14. Termination

You may terminate your account at any time via Settings → Account → Delete. We may suspend or terminate your account for material breach of these Terms or for legal compliance, with or without notice depending on severity.

Upon termination:

• Your access to the Services ends.
• You have 30 days to export Your Content via Settings → Privacy → Export Data before deletion.
• Hardware-execution credits expire at termination and are non-refundable.
• Sections 6 (IP), 10 (Disclaimers), 12 (Liability), 13 (Indemnity), 15 (Governing Law), and 17 (General) survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws rules. The exclusive forum for any dispute is the courts located in Seoul, Republic of Korea.

For users in jurisdictions where the foregoing forum-selection clause is unenforceable as a matter of consumer-protection law (notably certain EU member states), the dispute may be brought in the courts of your habitual residence, and Korean law shall still apply unless mandatorily overridden by your local law.

Before filing a formal claim, you agree to attempt good-faith resolution by writing to legal@swiftquantum.tech with a description of the dispute and the remedy sought. We will respond within 30 days.

16. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified to you with at least 30 days' advance notice by email and in-app banner before they take effect. Continued use of the Services after the effective date constitutes acceptance.

17. General

• Severability: if any provision is held unenforceable, the rest remain in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or asset sale on at least 30 days' notice.
• Force majeure: neither party is liable for delays caused by events beyond reasonable control (natural disasters, regulatory action, infrastructure outages).
• Notices to us: legal@swiftquantum.tech or the postal address below. Notices to you: to the email address on file, the in-app inbox, or a public notice on the website.
• Entire agreement: these Terms together with the Privacy Policy and any in-app supplemental terms are the entire agreement between you and us regarding the Services.
